1. Introduction

Welcome to Gracie Barra Montreal. By accessing or using our website (gbmontreal.ca) or enrolling in any of our programs, you (“you”, “participant”, “member”) agree to the following Terms & Conditions (“Terms”). These Terms govern your use of our website and your relationship with our academy.

2. Services Offered

We provide Brazilian Jiu-Jitsu instruction, classes for adults, kids & teens, women’s self-defense, private training, and related services (“Programs”). Each Program is subject to its own schedule, membership rules, and policies. These Terms do not substitute those individual Program rules, which prevail in case of conflict.

3. Use of Website

  • The website is for information, class schedules, membership signup, contact, and communication.
  • You may not misuse the site (e.g. hacking, scraping, transmitting malware).
  • We may suspend or terminate access for violations.

4. Registration & Participation

  • To enroll in classes, you must fill out a membership/waiver form (either online or in person).
  • For minors (<18 years old), a parent or guardian must sign the waiver.
  • You agree to follow instructions and safety rules given by instructors.
  • We may refuse service or membership at our discretion.

5. Payment, Membership & Refunds

  • Membership or class fees must be paid in advance or as per your agreement.
  • Late payments or non-payment may incur fees or result in suspension.
  • Refunds (if applicable) follow the policy set in your membership agreement (e.g. 30-day trial, cancellation terms).
  • We reserve the right to change fees with prior notice (e.g. 30 days).

6. Liability & Assumption of Risk

  • Training martial arts involves physical risk. By participating, you accept the inherent risks of injury.
  • You release Gracie Barra Montreal, its instructors, staff, facility owners, affiliates from liability for injury, loss, or damage, except in case of gross negligence or willful misconduct.
  • It’s your responsibility to maintain medical insurance and notify us of any health conditions.
  • You agree to follow safety rules; if you violate them, you may be removed from class.

7. Code of Conduct

  • Respect instructors, students, property, and facility.
  • No harassment, discrimination, or bullying.
  • Use proper attire (uniforms, hygiene).
  • No alcohol, drugs, or weapons on premises.
  • Failure to comply may result in suspension or membership cancellation (no refund).

8. Intellectual Property

  • All content on the website (text, images, logos, videos) is protected by copyright.
  • You may not reproduce, distribute, or use it without permission, except for personal, noncommercial use.

9. Data Collection and Privacy Acknowledgment

By using this website, you acknowledge and agree to our politique de confidentialité and expressly affirm the following terms:

  1. Necessary Disclosures: You affirm that you have received appropriate notice regarding our use of data identifiers, including Google signals, User-ID, and hashed User-provided data collection, and consent to the association of such data with the visitation information Google Analytics collects from this site for the purposes of analytics and personalized advertising. We only share your data with other third parties as required by law or for necessary business processes (e.g., billing, insurance, or service providers).
  2. Consent and Rights: You acknowledge that we have the necessary privacy disclosures and rights from you for the collection and processing of your data, and that you have been informed of your ability to access and delete this data via Google’s My Activity.
  3. Prohibited Information: You agree not to send or transmit any personally identifiable information (PII) to Google Analytics (e.g., via URLs, form fields, or User-ID) that Google could use or recognize as PII. You further agree not to use this site to transmit any data categorized as sensitive personal information (e.g., related to health, financial status, race, religion, or sexual orientation).

Your continued use of this site constitutes your acceptance of these terms and our data collection practices.

10. Reviews & Testimonials

  • By submitting reviews or testimonials, you grant us permission to use them (text, photos) in marketing materials, website, social media, without additional compensation.
  • You represent that the content is your own, doesn’t infringe rights, and you consent to publication.

11. Limitation of Liability

  • In no event shall Gracie Barra Montreal, its affiliates, instructors, or staff be liable for indirect, incidental, special, or consequential damages arising from participation or use of the website, even if advised of the possibility.
  • Our aggregate liability is limited to the amount you paid to us in the preceding 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Gracie Barra Montreal and its agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your breach of these Terms or actions in class or on premises.

13. Termination

  • These Terms remain active while you use our services.
  • We may suspend or terminate your account, class access, or membership if you breach the Terms.
  • Upon termination, your rights under these Terms immediately cease; sections 6, 8, 11, 12 survive.

14. Modifications to Terms

We may change these Terms at any time. The Effective Date above is when the current version applies. We’ll notify members in advance of major changes (e.g. via email). Continued use following changes means you accept them.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Quebec, Canada.
  • Any dispute shall be resolved before the courts in the judicial district of Montreal, QC.
  • You and we waive the right to jury trial (if applicable), and agree to the exclusive jurisdiction of those courts.

16. Severability & Waiver

  • If a term is invalid or unenforceable, the rest remain in effect.
  • If we don’t enforce a right immediately, that doesn’t waive the right later.

17. Entire Agreement

These Terms, plus your membership agreement, releases, and policies represent the complete agreement between you and Gracie Barra Montreal regarding your use, replacing prior oral or written agreements.
